Dirty Dirt Law Postponed ... for Now


Companies involved in the movement of dirt in New Jersey can take a breath of relief, at least for a while. Legislation was enacted last week that effectively postpones the implementation of the "dirty dirt" law for up to a year, and maybe longer. Within that year, the NJ Department of Environmental Protection must propose rules for the program and seek public comment, which will hopefully yield the clarifications necessary for what has otherwise been an onerous, confusing, and redundant process since the original law's passage. NUCA NJ, which has been part of a coalition of business groups seeking this postponement (among other improvements), applauds the legislative action. While the full application process is postponed, the registration requirement is not. For this reason, we encourage any members that may fall under this law to register by July 14. We will continue to monitor developments as they take place.
